                                ORDINANCE NO. 9738
        
        
                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO AMEND CERTAIN SECTIONS RELATIVE TO
                   PROJECTION OF PORCHES, PORTICOS, AND SIMILAR
                   STRUCTURES INTO REQUIRED YARDS.

              	   WHEREAS, the Building Department of the City of
         Chattanooga has requested clarification of certain language
         regulating the projection of porches, porticos, and similar
         structures into required yards; and
              	   WHEREAS, it is the intent of the ordinance to restrict 

         only those projections which exceed an acceptable minimum 
width;
         and
              	   WHEREAS, the Chattanooga-Hamilton County Regional
         Planning Commission has reviewed a proposed amendment to the
         Chattanooga Zoning Ordinance;
                                 NOW, THEREFORE,
              	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, 
the
         Zoning Ordinance, be and the same is hereby amended as follows:
              	   SECTION 1.	  That Article VI, Section 104 be amended
         so as to delete it in its entirety and the following section
         substituted in lieu thereof:
                   (104) A porch, portico, entry landing or
                         similar structure five (5) feet or less
                         in width may extend into the front and
                         rear required yards (setback areas) no
                         more than five (5) feet.
        
         	   SECTION 2.	  BE IT FURTHER ORDAINED that this
         Ordinance shall take effect two weeks from and after its 
passage
         as required by law.
